    Victoria’s Latest Legislation Aims to Boost Confidence in New Apartment Construction

    Victoria has unveiled plans to increase the construction of apartments across the state, and its latest legislation is designed to ensure that people are eager to live in these new high-rise homes. The state government announced on March 4th that it will introduce a new regulator with strong powers to oversee new home building.

    The legislation, known as the Building Legislation Amendment (Buyer Protections) Bill 2025, is all about creating more homes, according to Jacinta Allan, the state’s premier. She believes that if buyers have confidence in the quality and durability of new homes, especially off-the-plan apartments, they will be more likely to make a purchase.

    The bill includes several components, one of which is the establishment of a new watchdog called The Building and Plumbing Commission. This regulatory body will consolidate building insurance, dispute resolution, and compliance monitoring and enforcement. Its goal is to provide assurance that newly built homes, particularly those around transit hubs, will be well-made and of high quality.

    The Building and Plumbing Commission will act as a one-stop-shop for consumers who encounter issues with the quality of their newly built homes. Unlike the existing regulator, the new watchdog will have expanded powers for enforcement and can even halt the issuing of occupancy permits or the completion of off-the-plan sales for apartment buildings. The commission will also have the authority to order the rectification of faulty building work up to ten years after an occupancy permit is issued.

    To further boost confidence in the industry, the government will introduce a “developer bond” scheme. Under this scheme, the government will collect 2% of the construction cost of an apartment block and hold it for 24 months. This money will be used to pay for any necessary rectification work that arises within the first two years after the building is completed. Additionally, the government is considering implementing a 10-year liability scheme to cover apartment defects in the long term.

    Another significant change is the introduction of a “first resort” insurance scheme, overseen by the Victorian Managed Insurance Authority (VMIA). This scheme will allow consumers to make claims when building issues are first identified, helping them avoid out-of-pocket expenses.

    Looking ahead, the state is considering implementing more mandatory inspections during construction, specifically before waterproofing and plastering. The aim is to detect non-compliance earlier and address potential problems before residents move in. The state is also exploring the idea of mandating “building manuals” for new apartment buildings, which would centralize all documentation related to construction and maintenance in one location.

    Victoria’s new legislation and regulatory measures are expected to enhance confidence in the construction industry and encourage buyers to consider new builds. With a substantial pipeline of apartments planned for Melbourne and other regional cities in the state, these initiatives aim to ensure that these homes are of the highest quality and will stand the test of time.
